1.1 The sale of products offered on the website www.sissiottostyle.com (hereinafter referred to as the “Site”) is governed by the following General Contract Conditions (hereinafter referred to as the “General Conditions”).

1.2 Sissiottostyle is a trademark of Simona Bertolotto, registered in the Turin Company Register and VAT number 12249000014, registered in the Turin Economic and Administrative Index (REA) number 1304353, with registered office at Via dell'Arsenale 35/bis - 10121 Turin (TO).

1.3 The products offered on the www.sissiottostyle.com website  They are produced and marketed by Simona Bertolotto (hereinafter referred to as the Seller). 1.4 The purchase contract and related procedures are available in Italian.

2 BASIC INFORMATION

2.1 The products on the Site are offered for sale exclusively to natural persons resident in the European territory who purchase the products for personal purposes unrelated to their commercial or professional activity and who have reached the age of majority, with the destination of the goods within the European territory.

2.2 The resale, rental, or transfer of products purchased from the Site for any commercial or professional purpose is expressly prohibited. Therefore, purchase contracts made by retailers or wholesalers, or by persons purchasing the products for subsequent resale, are voidable pursuant to art. 1427 of the Italian Civil Code. In any case, the Seller reserves the right to terminate the contract at any time if it determines or has reasonable grounds to believe, also taking into account the quantity and type of goods purchased, that the buyer does not meet the requirements set out in art. 2.1.

2.3 The Seller reserves the right to make changes or additions to these General Conditions at any time by publishing them on the website www.sissiottostyle.com . In any case, the customer will be bound exclusively by the General Conditions in force on the date the purchase order is placed.

2.4 By submitting a purchase order, the customer acknowledges having carefully reviewed and fully accepted these General Conditions. In this regard, the Seller recommends that the customer download, save, or print the General Conditions in effect at the time the purchase order is submitted.

2.5 To place an order, it is not necessary to register on the Site, but it is necessary to accept the General Terms and Conditions of Sale by selecting the appropriate box. Failure to accept the Terms and Conditions will make it impossible to purchase the Products. The customer guarantees that the personal information provided during the purchase process is truthful.

3 PURCHASE PROCEDURE

3.1 Each product selected by the user of the Site can be viewed on a dedicated web page that contains the description, photographic images and highlights the unit price (including VAT), the colours and the different sizes available.

3.2 Each sale made by the Seller via the Site may concern one or more products.

3.3 By selecting the items of interest, the customer will include those products in their shopping cart. A brief summary description of the selected products, including measurements or sizes, will be displayed in the shopping cart, along with one or more digital photographs that provide an adequate representation of the products. It is understood that in the event of any discrepancies between the photographs and the summary description, the latter will prevail and be considered indicative of the purchased product.

3.4 The customer is required to verify the accuracy of the contents of the cart before confirming the order by completing the online purchase order form according to the purchasing instructions provided on the relevant page of the Site and confirming that they have read and accepted these General Conditions. Once the accuracy of the data relating to the selected Product(s) has been verified, the Customer must choose the payment method referred to in Article 5.

3.5 The purchase process is completed when the customer selects the "Confirm Purchase" option on the order summary page displayed upon completion of the relevant procedure. At this point, the order is sent directly to the Seller for processing and cannot be further modified or cancelled.

3.6 By sending the order, the customer confirms acceptance of the provisions of these General Conditions.

3.7 The purchase order will be stored at the Seller's data center.

3.8 The customer will also receive an order confirmation email, to the address provided in the online purchase order form, containing a summary of the main contractual conditions.

3.9 Although the Seller constantly takes measures to ensure that the photographs displayed on the Site represent as faithful a reproduction as possible of the actual products, some discrepancies may always occur due to the technical characteristics and color resolution of the terminal or screen used by the customer. As a result of the aforementioned technical reasons, the Seller assumes no guarantee or responsibility for the absolute accuracy of the graphic representations of the products shown on the Site.

3.10 The Seller reserves the right to refuse purchase orders from a customer it deems unfit to fulfill its obligations, such as, for example, a previous violation of the contractual provisions for online purchasing through the Site. In any case, it is understood that all purchase orders sent constitute contractual proposals and that the conclusion of the contract is at the discretion of the Seller, who is free to accept or refuse orders.

4 AVAILABILITY

4.1 The customer acknowledges that the stock of the products offered by the Seller through the Site is limited. The Site displays the products considered available for purchase by customers. Occasionally, issues with the availability of certain products may arise, without this implying any liability on the part of the Seller towards customers. In such circumstances, the customer will be informed of this fact as soon as possible (and in any case within the delivery times specified below) by email; consequently, the incomplete order will be cancelled and the customer will be offered the option to place a new order. Cancellation of the entire order will not result in any charges to the customer.

4.2 The Seller reserves the right to change or update the products offered on the Site at any time, without notice.

5 PRICE AND PAYMENT METHODS

5.1 The prices of all products offered for sale on the Site are expressed in Euros (€) and include VAT at the rate in force in Italy (currently 22%). 

5.2 The price does not include shipping costs. The Seller reserves the right to charge Customers a contribution towards shipping costs, which may vary depending on the type of delivery, the quantity of products to be delivered, their weight, and their destination.

5.3 The contribution requested by the Seller for shipping costs is indicated, separately from the Price, before the order is sent by the Customer and will be paid by the Customer together with the payment of the price.

5.4 The total amount, together with any shipping costs to be paid by the customer, if applicable, as specified below, will be highlighted in the Cart and on the order summary page displayed upon completion of the relevant procedure.

5.5 The Seller reserves the right to change the prices of the products offered for sale on the Site at any time and without notice. The customer will be charged the prices published on the Site at the time the order is placed, except as provided in Article 4.1 in the event of product unavailability.

5.6 The Seller only accepts payments made by credit card or PayPal. The Seller accepts the credit cards listed on the relevant page of the Site.

5.7 Products are shipped only after verification of the customer's credit card information. The customer's credit card will be charged only after the relevant order has been processed. The credit card information submitted when placing an order is protected and sent directly to the banking company that manages payments, which are processed directly on a secure server to ensure the absolute security of the transaction.

5.9 In the case of payment via PayPal, when customers submit their orders, the web session will be transferred to the PayPal website. On this website, customers can complete the payment of the Price and any shipping costs using their PayPal account and in accordance with the PayPal terms and conditions. The price and shipping costs will be charged to the PayPal account at the same time as the order confirmation is sent by the Seller.

5.10 The receipt will be sent with the goods in the package(s). To request a new one, please send a request via email to info@sissiottostyle.com .

5.11 In the event that one or more products are unavailable, the customer will be contacted by email as set forth in Article 4.1.

6 LIMITATIONS IN DELIVERY OF PRODUCTS

6.1 Deliveries are made to all European Union member countries. Products will be shipped to the postal delivery address indicated by the customer in the online purchase order form.

6.2 The Seller will not ship any order addressed to a PO box nor will it accept any order in which it is not possible to identify the person who placed the order, the recipient of the products ordered or the delivery address.

7 DELIVERY METHODS

7.1 The Seller uses Express Courier to ship orders. Products available in stock will generally be delivered as quickly as possible and, in any case, approximately:

• In Italy, within 3-5 working days of receiving payment.
• in EU countries other than Italy within 5-7 working days of receiving payment.

7.2 Shipping costs can be viewed by the customer, together with the total price for the purchase of the products, before confirming the order, in the Cart and on the purchase order summary page.

7.3 The Seller undertakes to do everything within its power to respect the delivery times indicated on the Site and, in any case, to carry out the delivery within a maximum of 30 (thirty) days starting from the day following the day on which the order is sent by the Customer.

7.4 Upon shipment of the package containing the ordered items, the Express Courier will send the customer an email to the address indicated in the online purchase order form. This email will contain a tracking code and a link that will allow the delivery to be monitored.

7.5 In the event of problems or delays in delivery exceeding 10 (ten) working days after the date indicated in the order confirmation email referred to in Article 3.8, customers are required to report the matter to info@sissiottostyle.com using the Contact section on the Website.

7.6 The customer undertakes to check as soon as possible that the delivery includes all and only the purchased products and to promptly inform the Seller of any defects in the products received or any discrepancies from the order placed according to the procedure set out in point 9 below; otherwise, the products will be deemed accepted. If the product packaging arrives at its destination visibly damaged, the customer is invited to refuse delivery from the carrier or to accept delivery "with reservations."

8 WITHDRAWAL AND RETURN

8.1 The customer has the right, pursuant to and for the purposes of Article 64 of Legislative Decree no. 206/2005, to withdraw from the sales contract, specifying the reasons, within 14 (fourteen) days from the date of delivery of the products, without any penalty.

8.2 Furthermore, the customer is guaranteed the right to return the products, which can be exercised within the same deadline provided for the right of withdrawal for one of the reasons listed on the Site in the “Withdrawal/Return Policy” section.

8.3 To exercise the rights set forth in Articles 8.1 and 8.2, the customer must follow the "Instructions" contained in the "Withdrawal/Return Policy" section of the Site.

8.4 In the event that customers exercise the rights of withdrawal/return referred to in this article:

(i) customers undertake in any case to return the products within 10 days from the date of exercising the right of withdrawal/return;

(ii) shipping costs associated with returning the products are the customer's responsibility. The customer will ship the item at their own expense, subsequently communicating the name of the shipping company and the tracking number to monitor the shipment to info@sissiottostyle.com ;

(iii) The Seller undertakes to refund the price as soon as possible, and in any case within 30 days from the date of receipt of the returned products, provided that they have been returned in their original condition, intact and unused, together with the original packaging/wrapping and any accessories, quality labels, and a copy of the sales documentation.

8.5 All refunds processed by the Seller will be made using the same payment method used to place the order.

8.6 The Seller will not provide any refund of the price if the customer exercises the right of withdrawal/return in a manner that does not comply with the methods and terms set out in the Withdrawal/Return Policy and this article.

8.7 The Seller will verify whether the returned products are in their original condition. If the products returned by the customer are damaged, incomplete, deteriorated, and/or dirty, they will not be refunded. The Seller reserves the right to request compensation for any damage or discrepancy with the products delivered to the customer. In the event of withdrawal or return, the Seller will not be responsible for lost products, shipments to incorrect addresses, or delays in delivery of products. It is understood that the customer assumes all risk for such shipment.

9. DEFECT OF CONFORMITY

9.1 Upon delivery, the customer must check the products to ensure they correspond to the items ordered. Any anomalies found upon delivery (for example, tampering with or damage to the packaging, damaged products, missing items, etc.) must be indicated on the delivery document in the form of an express reservation signed by the customer.

9.2 If the products do not correspond to those ordered, the customer is required to promptly inform the Seller at info@sissiottostyle.com and has the right to demand fulfillment of the order, subject to the return of the goods received. 9.3 The Seller is also liable in the event of a lack of conformity of the products, provided that the customer submits the complaint within a maximum of 7 (seven) days from the delivery date.

9.4 The costs incurred by the customer for the return of products found to be defective or non-compliant will be borne by the Seller.

10 LIMITATION OF LIABILITY

10.1 The Seller shall not be liable in any way towards the Customer as a result of:

(i) damage or loss caused by the products or their use by the customer (without prejudice in any case to the application of the mandatory provisions regarding the manufacturer's liability);

(ii) damages not caused by breach of contract by the Seller;

(iii) loss of business or business opportunity.

11 INTELLECTUAL PROPERTY RIGHTS

11.1 The Sissiottostyle trademark, as well as all figurative and non-figurative trademarks and, more generally, all other trademarks, illustrations, images, and logos featured on Sissiottostyle products, related accessories, and packaging, whether registered or not, are and remain the exclusive property of the Seller. Total or partial reproduction, modification, or use of the aforementioned trademarks, illustrations, images, and logos, for any reason and on any medium, without the prior express consent of the Seller is strictly prohibited. The Site and its contents (including the shop section) may only be used for personal, non-commercial purposes.

11.2 Any combination of the aforementioned trademarks with other trademarks, symbols, logos and, more generally, any distinctive sign suitable for creating a composite logo is also prohibited.

11.3 Furthermore, the total or partial reproduction, modification, transfer by electronic or conventional means or the use of designs, models and patents, which are the exclusive property of the Seller and therefore protected by the current legislation on distinctive signs, are absolutely prohibited.

12 PRIVACY

12.1 All personal data is treated with the utmost confidentiality according to the directives contained in the "Privacy Policy", which can be viewed in the appropriate section of the Site.

13 APPLICABLE LAW

13.1 These General Conditions are governed by and will be interpreted in accordance with Italian law, with the exclusion of the 1980 Vienna Convention on Contracts for the International Sale of Goods.

13.2 For any dispute that may arise in connection with the General Conditions and/or the Sales Contracts, the Court of Turin shall have exclusive jurisdiction.

Withdrawal Policy

• The Customer has the right to return the purchased product within 14 days of delivery, without having to provide any reason.
• To exercise the right of withdrawal, the Customer must inform the Seller via email to info@sissiottostyle.com , specifying the order number, personal data, the product to be returned and the reason for the return.
• The product must be returned to the Seller in the same condition in which it was delivered, with all accessories and original packaging and a copy of the sales documentation.
• The shipping costs for returning the product will be borne by the Customer,
• The Seller undertakes to refund the price of the product within 30 days of receiving the return,
• The Seller reserves the right to refuse returns if the product has been damaged or tampered with by the Customer. In this case, the product will be returned to the Customer and shipping costs will be borne by the Customer.
